TERMS & CONDITIONS POLICY

PROGRAM INCLUDES:

Rental Vehicle, Vehicle Insurance:

Fuels: Lead Vehicle, Service Vehicle. Service Team: Team leader, Driver, Local Guide.  Accommodations, Meals, Tickets/Entry Fees, Domestic Tickets.

PROGRAM DOES NOT INCLUDE:

Fuel for the rental vehicle, Airfare (international flight in and out of Thailand), Hotels (First and last evening in Bangkok for early or late arrival flights and early or late departure flight), Meals (Lunches), Snacks, beverages, refreshments, mini bars and room services.  Passport and Visa fees (Lao/Vietnam/Lao), Fines, Gratuities, Laundry services, Phone/Fax calls and Internet access fees (most of the hotel are with free internet connections) and personal medical, accidental insurance, emergency medical evacuation insurance (recommended), trip cancellation insurance, Tips for staff, special luggage or hotel services.

RESERVATIONS, DEPOSITS, FINAL PAYMENTS AND DUE DATE:

Reservations: Reservation can be made by application form.  Your spot on our selected tour will be reserved upon receipt of your application form plus a deposit or full payment by credit cards or bank transfer.  Your booking is considered final and binding on issuance of our letter of confirmation.

Deposits: Minimum deposit of 20% is required when making a booking.  Once you have paid a deposit, you will be protected from any price increases.

Final Payments: Balance must be paid within 60 days before your tour schedule dates.  If you book less than 45 days before departure, the initial payment must be paid, in advance, in full. All costs are quoted in Euro.  Prices are valid for year 2017/2018 programs season only and subject to change with notice. Deposits are fully applied to your final payment.  Organizer reserves the right to cancel reservations not paid in full by the due date.

CANCELLATIONS AND REFUND:

Please consider that the cancellation and refund policy is not meant to be punitive, but your cancellation could mean canceling the whole tour that is based on minimum of three and maximum of seven motorcycles.  When cancellation notice is short, organizer will have lost any possibility of replacing your spot with another biker. We do understand that there are unavoidable reasons for last-minute trip cancellation, so please take out trip cancellation insurance on your own accord to cover this situation. Organizer guarantees your tour departure and price with sending the letter of confirmation. We understand that once you have already planned your holiday and flight tickets are booked, it is difficult to make changes.

  • In the event of cancellation, you must notify RIDE ASIA in writing 90 days prior to Tour Departure Date to receive full refund of deposit with 5% deduction for administrative fees.
  • ny cancellation notice received 60 day prior to Tour Departure Date to receive 50% refund of the deposit with a 5% deduction for administrative fees.
  • Any cancellation notice received during a period of 31-60 days from Tour Departure Date is subject to loss of entire deposit, and may as well result in retaining additional portions of payments to cover any costs incurred as a direct result of your cancellation.  Should you find a replacement, a full refund will be given with a 5% deduction for administrative fees.

Any cancellation notice received 30 days or less from Tour Departure Date is subject to forfeiture of entire tour payment and deposit.

 

-A refund is not possible for no-shows, or for an unused portion of a tour.  If a tour has to be cancelled for any reason beyond RIDE ASIA LTD., PART.’s control before departure, a full refund will be paid.  If a tour is cancelled for any reason beyond the control of RIDE ASIA LTD., PART. during a tour, no refund can be granted.

 

LIABILITY:

Ride Asia Ltd., Part. will not be held responsible for any mishaps to yourself or your property, in particular those arising from a motorcycle accident involving you or a third party including other member of the group, consequence of flight cancellations, strikes, wars, riots, robbery, sickness, quarantine or weather, Government intervention and other such happenings.

Ride Asia Ltd., Part. will not accept liability for damage caused by the total or partial failure to carry out the contract if the failure is attributable to a passenger unforeseeable or unavoidable and attributable to a third party unconnected to the Company; or the result of circumstances beyond the Company’s control; or the result of circumstances beyond the Company’s control; or the result of an event that the Company even with all due care attention could not foresee or forestall. Where the Company is found to be liable for damages in respect of its failure to carry out the contract, the maximum amount of such damages will normally be limited to the price paid for the program only.  You undertake this program with the full understanding of your limitations and ability as a motorcycle rider and will not take risks that you deem to be beyond your riding capability.

 

TOUR ITINERARIES:

Tour itineraries are meant as a rough guideline only and Ride Asia Ltd., Part. Reserve the rights to alter any itinerary at any time to account for weather disturbances, local conditions or any reason directly or indirectly related to the group participating in the motorcycle tour program.

 

PERSONAL TRAVEL INSURANCE:

Personal travel insurance: is mandatory and not included in the cost of the program.  It is condition of your booking with us that each person or each member of a group booking, has travel insurance covering for the riding a motorcycle of 500CC or more (not in competition).

We advise that your travel insurance covers medical, repatriations, liability insurance and personal accident as a minimum.

We cannot be held liable in the event of any claim arising out of events beyond our control as a result of optional activities run by others, airlines or booking delays or cancellations or as a result of you taking part in activities that are not part of the original program.

Failure to provide proof of adequate travel insurance may result in the cancellation of the program.

 

MOTORCYCLES AND INSURANCE:

Motorcycles: The motorcycle use in this tour are the latest BMW R1200GS, BMW F800GS and BMW F700GS models, and we guarantee that our fleets of motorcycles are well maintenance, equipped with standard accessories.  Pannier system, top case, tank bags are optional equipment upon request when you make reservations.

 

Insurance: laws of the GENERAL INSURANCE ASSOCIATION OF THAILAND govern the motorcycles used on this program.

Honda Vehicles that are used in this program included compulsory 3rd party insurance coverage.

Third Party Liability

Bodily injury: 200,000-baht per person (+50,000 baht from compulsory 3rd party)

Death: 300,000-baht person (+100,000 baht from compulsory 3rd party)

Maximum per occurrence: 10,000,000 baht (+5,000,000 from compulsory 3rd party)

Property damage: 200,000 baht per occurrence.

PA (accident death & dismemberment): 50,000-baht (for driver)

Bail Bond (to get out of jail): 200,000-baht per occurrence.

BMW Vehicles that are used in this program included 1st class (comprehensive) insurance.  Deductible of any claim regardless of whether the accident or damage was caused by you or a third party.

Deposits: A rental vehicle deposits are required incase damages exceeding the cost of the motorcycles (insurance write off) you will be liable up to a maximum of €2,500.00 or 100,000.00 Thai Baht only.  A full amount of your deposit will be refunded to you within 1 week after the completion of your tour program.

INTERNATIONAL DRIVERS LICENSE/MOTORCYCLE LICENSE:

It is the law of Thailand, Lao, Vietnam, Cambodia and Myanmar that a foreigner must be in possession of an international driver license (or Thai license for resident of Thailand).  It is your responsibility to bring with you a valid international driver’s license, which should be carried with you at all time.

With the acceptation in China foreigner are require to have special temporary license that must be approved and issue by the People’s Republic of China motors vehicles department.  And licensee must be under sixty years of age.

DRIVER & PASSENGER REQUIREMENTS

Drivers: must be at least 30 years old and hold a current motorcycle driving license (with photo) from their country of residence and have held it for at least one year.  In additions, you will need an international driving license endorsed for motorcycles.  All local road rules must be complied with, with an attitude of due respect.  Your tour leader will give each rider a briefing about local speed limits, signage, and other applicable traffic regulations.  It is rider’s responsibility to adhere to all traffic regulations.  Full riding equipment is mandatory.

  • Passengers: Passengers must be at least 15 years old with full riding equipment mandatory.
  • Riders and passengers must be aware of traffic, road conditions, weather and other motorcyclists.
  • Riders and passengers understand that motorcycling is a dangerous activity and are aware of these risks, and fully accept those risks and are solely responsible for keeping their motorcycle under control, selecting proper speeds, and adhering to the applicable country ‘s laws.
  • Riders are solely responsible for their choice of riding style and speed selection even when following a tour guide in a convoy formation with other motorcyclists.
  • Riders and passengers, their heirs, successors, and assignors agreed to release, indemnify, and hold organizer, its agents, contractors and employees harmless from any liability or claims directly or indirectly related to participation on a tour.

ACKNOWLEDGMENT OF RESPONSIBILITY – TOUR ORGANIZER

  1. Organizer is responsible within the framework of the duty and care of merchants in good standing, for arranging and providing the services listed in the tour itineraries and descriptions.
  2. Organizer reviews its hotels and contractors on a continuous basis.
  3. Organizer is responsible for conscientious travel preparations.
  4. Organizer reserves the right to change any part of a tour to improve its content or to adapt to changing conditions and situations as they arise.
  5. Organizer is not responsible or liable for any delays or any changes in the schedule to accommodate unplanned events.
  6. Organizer is not responsible or liable for any accidents and/or bodily injury or death of riders and passengers resulting from the use of the motorcycle.
  7. Organizer is not responsible for any acts of God, strikes, theft, or other conditions beyond our control.
  8. Organizer is not responsible for any loss or damage of personal property while on tour.

 

ACKNOWLEDGMENT OF RESPONSIBILITY – RIDERS AND PASSENGERS Each rider and passenger will acknowledge and accept this Organizer’s TERMS & CONDITIONS and INDEMNITY and RELEASE FORM at the time of reservation by returning a filled in booking form. The participant’s signing of this CONDITIONS & INDEMNITY & RELEASE FORM upon arrival, will be the rider’s and passenger’s acceptance of the risks of personal injury, property damage, or any loss associated with motorcycling. Each rider/passenger rides at his/her own risk and is legally liable for injury or damage to fellow participants or other road users, whether being led by tour leader or otherwise. Each rider must ride within his/her own skill level and with due consideration for their own safety and that of their fellow travelers. Each rider and passenger must follow the directions of the tour leader.  The tour leader reserves the right to terminate a rider’s / passenger’s tour if he considers the rider / passenger is unsafe either to himself/herself / to others, / for offensive behavior, and thereby forfeiting the balance of the tour.

CURRENCY FLUCTUATIONS:

Tour prices are calculated based on currency exchange rates and tariffs in effect at the time of printing or publishing on a web site.  Once you have paid for a deposit, you will be protected from any price increases, and will not be required to pay any additional monies because of subsequent currency exchange fluctuations.  Prices on our web site are valid for year 2017-2018 only and subject to change without notice.

 

REQUIRED PHOTOCOPIED DOCUMENTS:

The participant should scan or take a photo of above documents and send them in email attachment prior to commencing the tour.

SPECIAL ARRANGEMENTS:

Persons leaving or failing to complete a tour for any reason must make their own arrangements for transportation, lodging, and cover the cost of motorcycle return to the tour’s ending destination, at their own expense, unless prior arrangements with organizer have been made.  Any cancellation refunds will consist of whatever monies can be recovered from hotels and other contractors, less administrative fees if applicable.

VERBAL ARRANGEMENTS:

Verbal arrangements changing the terms and conditions between you and organizer are only valid when confirmed in writing by organizer.  The above TERMS & CONDITIONS, in conjunction with web site tour descriptions and features, constitute the entire Agreement between you and organizer.  There are no other conditions, representations, guarantees, etc, than those set herein.

 

JURISDICTION:

The agreement between organizer and the participants shall be deemed to be made in Thailand and in case of disputes shall be decided in accordance with the law of contract and general law of Thailand.

The parties herein agreed that in case of any dispute they will be subject themselves according to the Court of Thailand.  The parties herein agreed to be bound by their decisions including all decrees and orders, interim or otherwise and specifically recovery proceedings.

 

PHOTOGRAPHIC AND FILM RECORDS

Organizer reserves the right to take photographs or film records of any of its trips, and to use any such photograph and film records for promotional, sales, brochures, or other commercial purposes.

WARNING

As you are ultimately in control of the motorcycle you take full responsibility of your actions.  We do our best to select routes that we perceive is within your riding ability however, you agreed that you will not attempt anything that you feel is beyond your riding ability.  Our team leader will not be held accountable if you ride outside of your riding capabilities.

If your riding is found to be dangerous to yourself, other members of the group, member of the general public of other road users we reserve the right to terminate your travel with us immediately or should you commit an illegal act or your personal behavior be judged to be a danger or nuisance to fellow travelers or members of the public without refund of the services including services part or unused.

It is very important to us that you are happy with your motorcycle adventure program and that you understand the nature or our program.  We would, therefore, as that you take a few minutes to read these terms & conditions and if you need clarification on any point please do not hesitate to contact us.
